Gene's Footnotes

I have never been impressed by the messenger and always inspect the message, which I now understand is not the norm. People prefer to filter out discordant information. As such, I am frequently confronted with, "Where did you hear that...." Well, here you go. If you want an email version, send me an email.

The dominoes are falling

First, Greece is collapsing, France, Portugal etc to follow, then Germany. The dollar will look strong as it becomes the place to put EU.  That is an illusion

The TIPS, the US inflation protection bonds were moving up this week, according to Bob, this is contrary to the dollar moving up.  Historically, the TIPS should go down. The smart money is moving into them.

Gold and silver are up, but historically they should be down as the US dollar is strong.....but....

So get that silver or TIPS, now.  Forget timing the market. The first domino is falling. Today's blips will be the floor of tomorrow.

Washington Post, from Greg:

HI lawmakers vote to limit Obama document requests

The Associated Press
Tuesday, April 27, 2010; 11:03 PM

HONOLULU -- Hawaii legislators have passed a measure allowing a state agency to ignore repeated requests from a person or organization for PresidentBarack Obama's birth certificate.
The measure approved Tuesday by the state Legislature would carve an exemption in the state's public records law and allow officials to ignore all kinds of duplicative requests, including those for Obama's birth certificate.
Hawaii Health Director Dr. Chiyome Fukino has issued two statements since 2008 saying she had seen vital records proving Obama is a natural-born American citizen. Obama was born in Honolulu to a Kenyan father and an American mother.
But state officials say they still get between 10 and 20 e-mails each week seeking verification of Obama's birth.
The bill now goes to Gov. Linda Lingle.
The bill is SB2937.
----
I like it when Fukino refuses to release information for privacy reasons, then tells you what is on file. Not a good lie. Who knows where the conclusion came from that the vital records prove Obama is a natural born citizen?  The hearsay of a clerk who was not suppose to release any private information?  The newspaper? Facts would be wonderful, no.  So, absent non-hearsay facts, just apply Occam's razor.

Nonetheless, Hawaii and The Washington Post agree Obama had a Kenyan father.

Slaughterhouse Cases83 U.S. 36 (1872): The Court discussed (not an opinion on the subject)  the Citizenship Clause of the Fourteenth Amendment:the phrase 'subject to the jurisdiction thereof' was intended to exclude from its operation children of ministers, consuls, and citizens or subjects of foreign states, born within the United States
The Supreme Court has not directly ruled on exactly what natural born means. Nonetheless, Mr. Obama's father was a British citizen and returned home after school.  He was the subject of a foreign state and his son was his son - perhaps a dual citizen who was required to renounce his British (Indonesian?) citizenships.  I have no idea why I am in triple space and can't remove it.

Crab Grass Argument: won't go away

Regarding a prior blog entry, see below a section from an interesting activist group fostering the return to the original grand jury concepts, which had been a citizens' tool, not a charade controlled by the state.

I have to say before getting a history lesson, I did not grok the origins of the Grand Jury system and was dismissive of what it has become. It is a joke, now.

Of course, I understand that some readers will just shoot the messenger, the grand jury organization, which is flipping out about no one examining Mr. Obama's credentials. In that way it is easy to avoid the message, but that does not mean the message is going away.

There are some half dozen cases working their way through various systems regarding Mr. Obama's right to be president and the failure of many to investigate that right. A recent Court ordered the Defendants, including Mr. Cheney, lest you think this is a right wing conspiracy, to get proper legal representation and come back, last week, as they showed up with a deputy attorney general. They are all looking for free legal help paid for by you.

I wrote to the attorney for the Plaintiff and suggested the United States is not the correct defense team for people who are accused of subverting the United States, namely Congressional leaders responsible for looking into legitimacy. He agreed and and noted that it is part of the action. A perfect example of impropriety and a conflict of interest. If you don't think so, just imagine Bush were president - now you will get it.

The web page doesn't give any source, but says Obama has spent over a million dollars, thusfar, to avoid producing a certificate of birth. Whatever the amount, it is significant.

Don't jump to conclusions that this is settled, read the section below. Hawaii won't accept its own Certification of Birth as proof of birth in Hawaii.

Of course fighting and avoidance is a legal right, but one wonders why refuse to produce a simple piece of paper? Obama was in Hawaii before the election and could have driven to the proper office to get a copy of the actual certificate, if he didn't have one.

An interesting piece is below. I did not use red and only use bold for a special highlight or name. I guess I am from another era. To me all that flamboyant typography makes you look crazy.

A CERTIFICATION of Live Birth and a Birth Certificate (A CERTIFICATE of Live Birth)… [notice the difference in the words "certification" and "certificate"] ARE TWO TOTALLY DIFFERENT DOCUMENTS.

A CERTIFICATION of Live Birth - the document that Team Obama produced - is a document that essentially proves that you exist and Barack Hussein Obama most certainly EXISTS - that point is not in dispute.

A CERTIFICATE of Live Birth (an ACTUAL BIRTH CERTIFICATE) - on the other hand contains more information. It gives the specific location of your birth, the hospital, the time of birth, the attending physician etc.

Bottom line, a Certification of Live Birth does not by any stretch of the imagination meet the Constitution requirement for proof of “natural born citizenship.”

For proof, Obama must submit a BIRTH CERTIFICATE showing he was born of a father and mother in the United States and that his parents were BOTH US Citizens. Everyone is now aware of the fact that Barrack Obama’s father was NOT a United States Citizen. {I am not sure this is correct re both parents}

For purposes of illustration see the images below. The first image is the CERTIFICATION of Live Birth that Team Obama released and the next image is an example of an actual CERTIFICATE of Live Birth (an ACTUAL BIRTH CERTIFICATE) from the State of Hawaii from approximately the same time that Obama was born.

The image of Mr. Obama's certification would not publish. If you want to see it, again, click on the "interesting" organization, above. Here is the second image, the underlying certificate.

Birth Certificate

Why is this important? Stated again, a Certification is just a computer printout that says Obama exits. It is NOT a Certificate of Live Birth (BIRTH CERTIFICATE) that is considered in Hawaii to be the TRUE Certificate. The Certificate of Live Birth specifically answers questions like WHERE were the father and mother born? What were the parents’ residences at time of birth? In other words, what were the legal statuses of the parents? Were they US Citizens? We know that the father was NOT a US Citizen.

If you think a Certification is a legal document then ask yourself why the State of Hawaii won’t even accept it? That’s right!

Example: The State of Hawaii maintains programs to encourage property ownership for native Hawaiians. In order to qualify for this you must process an application through Hawaii Department of Home Lands. The following is a guideline:

DHHL utilizes information that is found only on the original Certificate of Live Birth, which is either black or green. This is a more complete record of your birth than the Certification of Live Birth (a computer-generated printout).

If the State of Hawaii DOES NOT accept its own CERTIFICATION of Live Birth as proof that an individual was actually born in Hawaii, why should we? If Hawaii REQUIRES an ACTUAL BIRTH CERTIFICATE , WHY SHOULDN’T WE?

Off hand, one would think the data in the certificate would pop into the certification, but Hawaii doesn't think so. It is a puzzle easily remedied.

There is more apparently about an expert proving forgery and the use of photoshop, but we all have to work.

Update

From something called "Tulsa Today," thanks to Irene
...As I’ve written in five articles (which can be read on my website: http://www.joanswirsky.com/), the most crucial issue is the fact that Obama’s eligibility to be president is being seriously challenged by about 20 lawsuits, many of them waged by Democrats and Independents. Several of these suits have now reached the Supreme Court. They all claim that Obama does not meet one of the three criteria that the U.S. Constitution requires of anyone who runs for the presidency of the United States of America. That criterion is that he or she be a “natural born citizen” of the United States.

ImageDecember 1, writes attorney Thomas J. Latino, was “the deadline for the Obama legal team to file their response to the Berg Petition for a Writ of Certiorari. There was nothing. Mr. Obama has done what hasn't been done before…he] has blatantly ignored a request from the Supreme Court of the United States – our highest and most revered legal institution. Mr. Obama, quite frankly, has thumbed his nose at the highest court in our land.”

On December 5, Leo Donofrio, a plaintiff in Donofrio v. Wells, is scheduled to have his case heard by the nine Justices of the Supreme Court, who have agreed to hold a “Rule of Four” Conference. This means If four of the nine Justices agree that Donofrio’s case has merit, there is the potential for the Justices to issue a “stay” of the Electoral College vote on December 15, which would prevent the Electoral College members from casting their votes until this explosive issue has been resolved.

A writ of certiorari can be ignored by the Supreme Court. I think, last I looked, only 2-3% of them were even heard. You don't default by not responding. However, it is curious that a claim this serious is not even met. That is, Mr. Obama is relying on the lower court's standing decision without any interest in bolstering any position. All I can say, its not something ordinarily done, even when you are sure of yourself, not if you don't want to be sued.

Frankly, I do not know if the Supreme Court will be able to say there is standing, then decide the matter. They might decide to do so, gather up all claims, as this issue is creating a mess of cases. If Mr. Obama is OK in this area, we should all hope it is cleared up. We can worry whether he is the Manchurian Candidate another day. Talk about a millstone.

I talked with Ray about Birth Certificates and Certificates of Birth, if you are interested. He had looked at his kids papers.

One point he made was the original is always kept by the State. Sounds sensible, but I recall seeing an old birth certificate that sure looked like an original, footprint and all. My current certificate does not have any of that.

Second, he says you don't register the hospital. There is an issue of fact, as lawyers call it. Someone else will look at that, I am sure.

Third, of interest, he say the mother's address is used to identify the person born. That makes sense.

We agree that one can get a passport even if not born here. So, that is of no help.

You may recall two State Dept. workers were fired for breaching Obama's passport file. Of interest is the Obama reply: denounced the accessing as "an outrageous breach of security and privacy, even from an Administration that has shown little regard for either over the last eight years." So, they accuse the administration of the breach. Little touchy, no?

To confuse matters, here is a photo of Obama (Soetero's) Indonesian school form

Translation:

http://smithfiles.com/wp-content/uploads/2008/08/angkatxt3.png

Who knows what all this means. I suppose his mom could lie to get him into school. However, this is a problem.

There is a controversy about Obama getting his first passport in 2005 (James Buchanan). Also, in the PA lawsuit it is alleged that one could not get into Pakistan with a U.S. passport at the time Obama went. etc etc. Further, he didn't tell anyone about his three week trip until it was discovered in the campaign and he had to reply to questions.

The problem is, if he had an Indonesian passport, he was Indonesian. Period. He was allowed, I think, to repatriate, but, then, he would not be a naturalized citizenship. There is no proof of repatriation, which is understandable if that is what he did.

Anyway, just some observations. It looks as though the Court will look at this. I don't think it is wise, on a political level, to avoid the issue by claiming "standing" problems. This issue will just grow and over-shadow things. Eventually, too, some document from somewhere will surface.

So, the Rule of Four goes online on 12/5, so we will see what happens. Even if conspiracy people are nuts and there is no clamping down on discussing this case (they say conservatives clammed up on the same day and nuke strikes are threatened if Obama is found not eligible), I don't think the Court will be swayed by direct threats, though they are sensitive to the big picture. (Dred Scot is an example of a sensitive screw up.)

Since there are four-five traditionalist judges, then the initial review should be fair, a positive finding meaning only further examination is approved. If that happens, you just may find the news covering this storm instead of the hurricane party. At that point, you will be the center of conversation at the party, having been informed herein.

Ray II

Ray says I was beaten up by Dale re the last blog, the one about the commie camp. Ray says the photo in question came from a racist site, to which my reaction is that doesn't mean the photo is not a photo. I will get to the letter, sorry.

If I looked now I would blow the rest of the day having fun. This is not allowed. Anyway, I am not saying anything, just that King and Parks were there. I don't think anyone denies it. I guess one could say they were there together, but had no interaction as well as the man on the moon is smiling. I just wanted to show the stuff to Ray, as he hadn't heard of the background

Today's Riff: Ray said he found an Obama birth certificate online, contrary to concerns over alleged absence of same, I previously reported. I found it too and thought I would put it up, the answer being clear. It is here

I didn't put it up, for a reason. Take a look at it closely. Then, closer. (This is great conspiracy) In the interest of journalism, I read a site that said, basically, don't fall for the certificate. I didn't think much of the grumbling until the writer pointed out that the date is not printed on the certificate paper. It has a white background. This is very Miami Vice curious. HERE

Even if he is a racist, the white is still there. Something is wrong, there, if you can follow the photoshop argument.

Recall Mel Gibson in his film Conspiracy Theory? He was the editor of a small-circulation conspiracy publication, I recall, and spent his life in quest of paranoid conspiracies. At being told he was targeted for revealing a secret, he says something like, "You mean I am right?" Anyway, I laughed.

The nay-sayer's criticism is intriguing, as I downloaded the certificate and increased its size as much as I could see. It is very curious; he looks right. Then, I noticed the impression coming through from the back side: the Certificate was dated Nov. something, 2007. I felt like an FBI agent.

So, the campaign went out and got a repro, OK - no problem, it would explain the perfect image, but that white stuff is intriguing and would suggest an alteration. I can hear Dale steaming.

Personally, I don't want to spend time on this, just creating trouble.

Anyway the certificate says void if altered and the number is blocked out (electronically, hmmm), so it is no good. So, if you go by the certificate, we still haven't seen the valid certificate. (Just kidding).

I am now wondering what I could do with a birth certificate number.
